(a) is in any way contrary to, disregards or infringes the fundamental rights and public freedoms recognised in the constitution, in international Treaties and in other legislation; (b) induces, incites or promotes criminal, denigrating, defamatory, infamous or violent actions or, in general, actions that are contrary to the law, generally accepted morals and good customs or public order; (c) induces, incites or promotes actions, attitudes or thoughts that are discriminatory on the grounds of sex, race, religion, beliefs, age or condition; (d) incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, generally accepted morals and good customs or public order; (e) is false, ambiguous, inaccurate, exaggerated or extemporaneous, in such a way that it induces or may induce error regarding its object or the intentions or purposes of the communicator; (f) is protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained the necessary authorisation from the owners to carry out the use they make or intend to make; (g) violates the business secrets of third parties; (h) is contrary to the right to honour, personal and family privacy or to one’s own image; (i) in any way harms the credit of MERCADOS ARIES or of third parties; (j) infringes the regulations on the secrecy of communications; (k) constitutes, where applicable, illicit, misleading or unfair advertising and, in general, constitutes unfair competition; (l) incorporates viruses or other physical or electronic elements which may damage or impede the normal operation of the network, system or computer equipment (hardware and software) of MERCADOS ARIES or of third parties or which may damage the electronic documents and files stored in said computer equipment; (m) causes due to its characteristics (such as format, extension, etc.) difficulties in the normal operation of the Service.

In accordance with the above, the User agrees to use the contents made available to Users on the web page, understanding by this, without this list being restrictive, the texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as its graphic design and source codes (hereinafter, the “Contents”), in accordance with the law, these Conditions of Use, other notices, regulations of use and instructions brought to the User’s attention, as well as with generally accepted morality and good customs and public order and, in particular, undertakes to refrain from: (a) reproducing, copying, distributing, making available or in any other way publicly communicating, transforming or modifying the Contents, unless the User has the authorisation of the holder of the corresponding rights or it is legally permitted; (b) suppressing, manipulating or in any way altering the copyright and other data identifying the reservation of rights of MERCADOS ARIES, the digital fingerprints or any other technical means established for their recognition.

The User shall refrain from obtaining or even attempting to obtain the Contents by using means or procedures other than those which, as the case may be, have been made available for this purpose or have been indicated for this purpose on the web page where the Contents are found or, in general, those which are habitually used on the Internet for this purpose, provided that they do not entail a risk of damage or disablement of the web page, the Services and/or the Contents.

(a) de cualquier forma sea contrario, menosprecie o atente contra los derechos fundamentales y las libertades públicas reconocidas constitucionalmente, en los Tratados internacionales y en el resto de la legislación; (b) induzca, incite o promueva actuaciones delictivas, denigratorias, difamatorias, infamantes, violentas o, en general, contrarias a la ley, a la moral y buenas costumbres generalmente aceptadas o al orden público; (c) induzca, incite o promueva actuaciones, actitudes o pensamientos discriminatorios por razón de sexo, raza, religión, creencias, edad o condición; (d) incorpore, ponga a disposición o permita acceder a productos, elementos, mensajes y/o servicios delictivos, violentos, ofensivos, nocivos, degradantes o, en general, contrarios a la ley, a la moral y a las buenas costumbres generalmente aceptadas o al orden público; (e) sea falso, ambiguo, inexacto, exagerado o extemporáneo, de forma que induzca o pueda inducir a error sobre su objeto o sobre las intenciones o propósitos del comunicante; (f) se encuentre protegido por cualesquiera derechos de propiedad intelectual o industrial pertenecientes a terceros, sin que el Usuario haya obtenido previamente de sus titulares la autorización necesaria para llevar a cabo el uso que efectúa o pretende efectuar; (g) viole los secretos empresariales de terceros; (h) sea contrario al derecho al honor, a la intimidad personal y familiar o a la propia imagen de las personas; (i) de cualquier manera perjudique el crédito de MERCADOS ARIES o de terceros; (j) infrinja la normativa sobre secreto de las comunicaciones; (k) constituya, en su caso, publicidad ilícita, engañosa o desleal y, en general, que constituya competencia desleal; (l) incorpore virus u otros elementos físicos o electrónicos que puedan dañar o impedir el normal funcionamiento de la red, del sistema o de equipos informáticos (hardware y software) de MERCADOS ARIES o de terceros o que puedan dañar los documentos electrónicos y archivos almacenados en dichos equipos informáticos; (m) provoque por sus características (tales como formato, extensión, etc.) dificultades en el normal funcionamiento del Servicio.
